2017 Family Code Amendment Gives New Stepparent Options

Effective January 1, 2017 the California legislature has amended section 9001. It now mandates that all Superior Courts accept stepparent investigations by licensed adoption agencies and licensed clinical social workers, rather than just by the designated county entity. Previously, the courts could reject "private" investigations. This allows adopting stepparents to have an option to the county entity in those counties where backlogs exist and it is a year or more to complete even a basic and uncontested stepparent investigation. Private agencies/social workers often complete the process in only three weeks. Here is the statute:

No increase in county fees

Good news. There was some talk in the bureaucracy of an increase in county court and investigation fees for 2016. Luckily, however, the filing fee remains at only $20.00. Also, the county investigation fees for the counties I work in most option (Riverside, San Bernardino, San Diego and Orange) did not increase.

Adult Stepparent Adoptions

Often people only think of stepparent adoption as only regarding children. Each year, however, I'm asked to complete several adult stepparent adoptions. Often this happens when either the child's absent birth parent would not consent to the adoption when the child was under 18, there was a need to continue with the absent parent's child support payments which would have been lost when finalizing a stepparent adoption, or perhaps everyone involved was not yet ready to complete a stepparent adoption at that point in time.
